1. Agreement to Terms

By accessing or using SprayingSoles ("the Site"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using this Site.

2. Age Restriction

You must be at least 18 years of age to access or use this Site. By using the Site, you represent and warrant that you are at least 18 years old. The Site contains adult content intended for mature audiences only.

3. User Account & Subscription

Account Responsibility: You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized access to your account.

Subscription Terms: Access to premium content requires an active subscription. Subscriptions are billed on a recurring basis until cancelled. We reserve the right to modify subscription pricing with 30 days notice to active subscribers.

4. User-Generated Content

Platform Nature: SprayingSoles is a platform that allows users to upload and share content. We do not claim ownership of user-uploaded content and are not responsible for content posted by users.

Upload Certification: By uploading content to the Site, you certify that:

  • You own all rights to the content OR have explicit authorization to distribute it
  • The content does not infringe on any third party's intellectual property rights
  • The content complies with all applicable laws and these Terms of Service
  • You are legally authorized to grant the license described below

License Grant: By uploading content, you grant SprayingSoles a non-exclusive, worldwide, royalty-free license to host, display, distribute, and transmit your content solely for the purpose of operating and promoting the Site. This license terminates when you delete your content or close your account.

Content Moderation: We reserve the right to review, approve, reject, or remove any user-uploaded content at our sole discretion, with or without notice. All uploads are subject to moderation before appearing on the Site.

5. Copyright & DMCA Compliance

Respect for Copyright: We respect intellectual property rights and expect our users to do the same. We comply with the Digital Millennium Copyright Act (DMCA) and respond promptly to valid takedown notices.

DMCA Takedown Process: If you believe your copyrighted work has been uploaded without authorization, please submit a DMCA takedown notice to our designated agent. Your notice must include:

  • Identification of the copyrighted work claimed to be infringed
  • URL(s) of the infringing material on our Site
  • Your contact information (email, phone, mailing address)
  • A statement that you have a good faith belief the use is unauthorized
  • A statement, under penalty of perjury, that the information is accurate and you are authorized to act
  • Your physical or electronic signature

Counter-Notification: If your content was removed due to a DMCA notice and you believe the removal was in error, you may submit a counter-notification. We will forward it to the complainant and may restore the content if they do not file a legal action within 10-14 business days.

6. Copyright Strike Policy

Three-Strike System: We maintain a repeat infringer policy to protect copyright holders:

  • First Strike: Warning issued; content removed
  • Second Strike: Temporary suspension of upload privileges
  • Third Strike: Permanent account termination

Strikes expire after 90 days if no additional violations occur. Users may appeal strikes by providing evidence of authorization or fair use.

7. Prohibited Content & Conduct

You may not upload or share content that:

  • Infringes on intellectual property rights of others
  • Contains malware, viruses, or harmful code
  • Depicts or promotes illegal activities
  • Contains minors or content involving minors in any context
  • Violates any applicable local, state, national, or international law
  • Harasses, threatens, or defames others
  • Impersonates any person or entity

8. Indemnification

You agree to indemnify, defend, and hold harmless SprayingSoles, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:

  • Your access to or use of the Site
  • Your violation of these Terms of Service
  • Your infringement of any intellectual property or other rights of any third party
  • Content you upload to the Site

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPRAYINGSOLES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

We do not guarantee the accuracy, completeness, or usefulness of user-uploaded content and are not responsible for content posted by third parties.

10. Privacy

Your use of the Site is also governed by our Privacy Policy. We collect minimal personal information and do not sell user data to third parties. Payment processing is handled by secure third-party providers.

11. Termination

We reserve the right to suspend or terminate your account and access to the Site at our sole discretion, without notice, for conduct that we believe:
